1) Scope of application
1.1 These General Terms and Conditions (hereinafter “GTC”) apply to all contracts for pet funeral and cremation services and for the purchase of urns and accessories that a Customer concludes with the Provider via the website animea.de. The Customer's own terms and conditions shall not apply unless the Provider expressly agrees to them in writing.
1.2 A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor attributable to their independent professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.
2) Conclusion of contract
2.1 The service and product descriptions presented on the website do not constitute binding offers by the Provider, but serve for the Customer to submit a binding offer.
2.2 Via the online booking assistant and shop on animea.de, the Customer can select services and goods, place them in the virtual shopping cart and complete the electronic ordering process. By clicking the button that concludes the ordering process, the Customer submits a legally binding contractual offer regarding the services and goods contained in the shopping cart.
2.3 The Provider may accept the Customer's offer within five days,
- by sending the Customer an order confirmation in text form (e.g. email), whereby receipt of the order confirmation by the Customer is decisive, or
- by commencing performance of the service at the Customer's express request and notifying the Customer thereof, or
- by requesting payment from the Customer after the order has been placed.
If more than one of the above alternatives applies, the contract is concluded when one of the alternatives first occurs. The period for acceptance begins on the day after the Customer sends the offer and ends at the close of the fifth day thereafter. If the Provider does not accept the offer within this period, this shall be deemed a rejection and the Customer shall no longer be bound by their declaration of intent.
2.4 The contract text is stored after conclusion of the contract and transmitted to the Customer in text form (usually by email). The Provider does not make the contract text permanently accessible beyond this, unless required by law.
2.5 Before submitting a binding order, the Customer can identify input errors by carefully reading the information displayed on the screen and correct them during the electronic ordering process until the ordering process is concluded.
2.6 The German language is decisive for the conclusion of the contract. The website may be displayed in other languages; in case of doubt, the German version of these GTC applies.
2.7 Order processing and contact usually take place by email and automated order processing. The Customer must ensure that the email address provided is correct and that messages sent by the Provider can be received, including when SPAM filters are used.
3) Right of withdrawal
Consumers are generally entitled to a right of withdrawal. Further information can be found in the Provider's cancellation policy.
4) Prices and payment terms
4.1 Unless otherwise stated, the prices quoted on the website are total prices in euros including statutory VAT.
4.2 The payment methods and payment modalities offered in the ordering process are communicated to the Customer before the order is concluded.
5) Performance of services
5.1 Services (in particular pickup, cremation, individual or communal burial) are provided in accordance with the service features and dates agreed in the ordering process. The Provider informs the Customer about the further procedure after conclusion of the contract.
5.2 Goods (urns, accessories) are shipped to the delivery address specified by the Customer unless otherwise agreed. Delivery times are set out in the product or service description in the ordering process.
5.3 The Customer is obliged to provide the Provider with all information required for performance truthfully and completely.
6) Applicable law
6.1 The law of the Federal Republic of Germany applies to all legal relationships between the parties, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as the protection granted by mandatory provisions of the law of the state in which the consumer has their habitual residence is not withdrawn.
6.2 This choice of law does not apply with regard to the statutory right of withdrawal to consumers who, at the time of conclusion of the contract, do not belong to a Member State of the European Union and whose sole place of residence and delivery address are outside the EU.
7) Place of jurisdiction
If the Customer acts as a merchant, a legal entity under public law or a special fund under public law with its registered office in Germany, the exclusive place of jurisdiction for all disputes arising from this contract is the Provider's place of business in Laudenbach. In any event, the Provider is entitled to bring an action before the court at the Customer's place of business.
8) Alternative dispute resolution
The Provider is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
